End User License Agreement (EULA) for Archive Portland Mobile Application

This End User License Agreement ("EULA") is a legal agreement between you and Archive Portland concerning your use of the Archive Portland mobile application ("the App"). Please read this EULA carefully before using the App. By downloading, installing, or using the App, you agree to be bound by the terms and conditions of this EULA.

1. License Grant

Archive Portland grants you a non-exclusive, non-transferable, limited license to install and use the App on a mobile device that you own or control, and to access and use the App on such device strictly in accordance with the terms and conditions of this EULA.

2. Restrictions

You may not:

a. Make unauthorized copies of the App;

b. Use the App for any purpose not explicitly permitted by this EULA;

c. Modify, adapt, or translate the App;

d. Reverse engineer, decompile, disassemble, or create derivative works based on the App;

e. Rent, lease, lend, sell, redistribute, or sublicense the App.

3. Ownership

The App is the property of Archive Portland and is protected by copyright and other intellectual property laws and treaties. Archive Portland retains all rights, title, and interest in and to the App, including all intellectual property rights.

4. Updates

Archive Portland may from time to time provide updates or upgrades to the App. Such updates may be necessary for the continued use of the App and may be automatically installed without providing any additional notice or receiving any additional consent.

5. Termination

This EULA is effective until terminated. Your rights under this EULA will automatically terminate without notice from Archive Portland if you fail to comply with any term of this EULA.

6. Disclaimer of Warranty

The App is provided "as is", without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Archive Portland shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, good-will, or other intangible losses, resulting from your use of the App.

8. Governing Law

This EULA shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of law principles.

9. Entire Agreement

This EULA constitutes the entire agreement between you and Archive Portland regarding the App and supersedes all prior or contemporaneous understandings and agreements, whether written or oral.

By using the App, you acknowledge that you have read and understood this EULA and agree to be bound by its terms and conditions. If you do not agree with these terms, you should not use the App. This EULA is effective as of the date you download, install, or use the App.
